The Fabius Township Zoning Board of Appeals handles requests for variances from the requirements of the Zoning Ordinance. Most such requests involve setback distances from the front, rear, or side lot lines.
Normally, the Zoning Administrator / Building Inspector will point out when a variance may be needed and provides application forms.
To be granted a variance from the Zoning Ordinance, an applicant has to show that a peculiar or exceptional practical difficulty would occur if the ordinance was strictly enforced. Reasons, such as narrowness, shallowness, shape, area, or topography, must be shown. The problem cannot be self-created and the solution must not substantially interfere with others or be a detriment to the public good.

Decisions of the ZBA can only be modified or overturned by an appeal to the Circuit Court. By law, neither the Township Board nor the Planning Commission may have any influence on variance decisions.
